The incident in query occurred in Las Vegas in 2004 when Carey was holidaying with then-wife Sally McMahon.

In February 2006 Carey introduced he was leaving his pregnant spouse Sally for mannequin Kate Neilson. 

He was subsequently accused of assaulting Neilson throughout a vacation in Miami, Florida.
